Privacy Policy

Welcome to the Privacy Policy (the “Policy”) for the Mood website (“Website”), the Mood mobile application (“App”), and all services provided through the Website or the App (“Services,” and collectively the Website, the App, and the Services are the “Platform”), made available by 2-4-3 Foundation (“Mood” or “we”). The purpose of this Policy is to inform you how we collect, use, and share your information when you provide such information or use the Platform.

When we refer to “you” or “your” in this Policy we mean any individual who interacts with or uses our Platform. By accessing or using the Platform, you represent that you understand and agree to this Policy, and consent to the collection, use, and sharing of information as described in this Policy. If you do not consent to our practices, you can choose not to use the Platform.

Privacy Policy Changes. We reserve the right to modify this Policy at any time without notice. All changes are effective immediately upon posting. Your continued use of the Platform after changes are posted constitutes your acknowledgement of the modified privacy policy and agreement to abide and be bound by that privacy policy. For reference, the effective date of this Policy is posted at the top of this page. Therefore, it is important that you periodically check this page for changes made to this Policy.

CHILDREN’S PRIVACY

We are committed to protecting the privacy of children.  First, users of our Platform who are under thirteen (13) years of age must get permission from a parent or guardian to use the Platform.  Second, to create an account to use the Platform, users must provide only a first name and a date of birth; we do not require a last name or an email address.  The last name and the email address of users of age thirteen (13) years and older, and the last name and email address of a parent or guardian of a user aged under thirteen (13) years, may be provided to us voluntarily, e.g., in connection with contacting us with a question or concern).  To the extent that we collect any personal information from children under the age of thirteen (13) years old (as defined by the U.S. Children’s Online Privacy Protection Act and regulations thereunder), we process such information solely to provide the Platform to the user and for the purposes set forth in our Terms of Use and as described in this Policy.  We process only as much information as is necessary to provide our Platform, and, by contacting us, the parent or guardian of a user under the age of thirteen (13) years old may access, delete, or withdraw consent for continued processing of such a user’s personal information at any time.  If you are a parent or guardian of such a user, you may review or have deleted your child’s personal information and refuse to permit further collection or use of your child’s personal information.  To exercise any of these rights, please contact us using the information provided below.  If you believe we have inadvertently collected personal information from a child under the age of thirteen (13) years old without proper consent, please promptly contact us using the contact information below. This will allow us to delete such information as soon as possible. 

INFORMATION WE COLLECT

Information You Voluntarily Provide

To provide our Platform, Mood needs to learn certain personal information about you. Mood collects information about you when you interact with our Platform, including information that you voluntarily provide when you: register and create an account for any part of the Platform; add or update your account information; complete any survey, questionnaire, or form of information request from Mood; submit a Contact Us inquiry; or when you otherwise interact with the Platform. Information that we collect may depend on how you interact with Mood and use the Platform. A description of the types of information we may collect is described in detail below.

  • Personal Identifiers such as first name (required to register an account) and last name (optional).

  • Contact Information such as your email address (optional).

  • Usage Data, includes information about how often you use the Platform and statistics regarding the opening of and clicking on links within emails that we send to you.

  • Marketing and Communications Information, if you provide your email for such purposes, such as marketing campaign data, click-throughs, your preferences and consent to receiving marketing from us and third parties, your communication preferences, and email you may send to us.

  • Internet and Other Electronic Network Activity such as device fingerprint, internet protocol (IP) address, time zone setting and location, language preferences, device type and ID, operating system and other technical information from the devices you use to access our Platform.

USE OF YOUR INFORMATION

Our primary purpose for collecting your information is to provide you with the services you request. We may also use your information in order to:

  • Provide you with our Platform and to operate our business.

  • Provide you with required notices and updates about our content, products, and services, as well as other important information.

  • Provide you with recommendations for content, products, and services that we believe would be of interest to you.

  • Assist you with setting up and managing your account with us.

  • Resolve disputes and questions about our Platform.

  • Troubleshoot problems and conduct data analysis, testing, system maintenance, support, and reporting.

  • Enforce our terms for use of our Platform and the terms of this Policy.

  • Customize, measure, and improve our Platform and content.

  • Conduct our own internal business processes and further internal business purposes.

  • Communicate with you about content, products, services, updates, events, promotional offers, research, insights, and other information that may be of interest to you from us and our trusted partners.

  • Protect our interests, including establishing, exercising, and defending legal rights and claims.

  • Comply with legal requirements, prevent fraud, co-operate with law enforcement and regulatory authorities, and stop other prohibited, illegal, or harmful activities.

INFORMATION WE SHARE

Service Providers

We may use third-party service providers to perform certain business services and may disclose your information to such service providers as needed for them to perform these business services. Service providers are only allowed to use, disclose, or retain this information to provide these services.  Business services provided include, but are not limited to, hosting services; account authentication and user verification services; marketing, promotional and email services; customer and technical support services; quality assurance testing, and back-office support for the Platform.

Other Third Parties

We may share your information with our affiliated entities, successors, assigns, licensees, or business partners, and others who may use the information for the purposes described above.

Business Transactions

We may do business with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then your information may be transferred to the new owners who may use your information in the same way as set out in this Policy.

Legal Process

Subject to applicable law, we may disclose information about you i) if we are required to do so by law, regulation, or legal process, such as a subpoena; ii) in response to requests by government entities, such as law enforcement authorities; iii) when we believe disclosure is necessary or appropriate to prevent physical, financial, or other harm, injury, or loss; or iv) for the purposes of cooperation with law enforcement agencies’ and/or in connection with an investigation of suspected or actual unlawful activity.

COMMUNICATIONS AND OPT-OUT

While we value our communications with you, if you do not want Mood or its representatives to contact you for marketing purposes, you may opt-out of this preference at any time by following the unsubscribe instructions included in our emails. This opt-out will not apply to operational or informational emails related to your account or other administrative purposes. You may continue to receive promotional email messages for a short period while we process your request.

SECURITY

We implement and maintain security measures and policies designed to protect your information against its unauthorized use, disclosure or access. However, no transmission of data over the Internet is guaranteed to be completely secure. Although we take steps to protect your information, we cannot guarantee the security of your information transmitted to our Platform. Any such transmission is done at your own and sole risk.

NOTICE TO CALIFORNIA RESIDENTS

Your California Privacy Rights. California Civil Code Section 1798.83 permits California residents who have provided personally identifiable information to us or our third-party advertisers and marketing partners, if any, to request certain information regarding our disclosure of personally identifiable information to third parties for their own direct marketing purposes. Requests should be submitted via email to info@mood.org and should include CALIFORNIA PRIVACY RIGHTS in the subject line. Please be aware that not all information sharing is covered by the requirements of Section 1798.83 and only information on covered sharing will be included in our response. This request may be made no more than once per calendar year.

 

Your ‘Do Not Track’ Browser Setting. Some web browsers incorporate a Do Not Track (“DNT”) feature that signals to the websites that you visit that you do not want to have your online activity tracked. At this time, our Website does not respond to DNT signals. Other third party websites may keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their websites.
